Who Says Yes: The NRC and the Licensing Gauntlet
An independent agency licenses every reactor, inspects every plant daily, and publishes the data this map runs on. Here's how the process works and why it's changing.
Every commercial reactor in the United States operates under a license from the Nuclear Regulatory Commission (NRC) — an independent agency, deliberately separated in 1975 from the government's nuclear-promotion role (which went to what became the Department of Energy) so that the referee and the cheerleader would never again be the same body. Five commissioners, ~3,000 staff, funded mostly by fees on the industry it regulates, with resident inspectors stationed full-time at every operating plant. The NRC's continuous oversight is also this map's plumbing: the daily Power Reactor Status Report driving the live layer, the license-expiry dates in the detail panels, and many of the milestone events in the news feed are all artifacts of the regulatory machine described on this page.
A reactor's life in licenses: the classic path (10 CFR Part 50) issued separate construction and operating licenses — build at your own risk, then prove the as-built plant before fuel load, a sequencing that financially wrecked projects in the 1980s when finished plants sat idle in licensing. The modern path (Part 52) front-loads everything: a standardized design is certified once (a multi-year review of the design itself — NuScale's became the seventh design and first SMR ever certified), sites can be pre-approved, and a combined license (COL) authorizes construction and operation together, with only as-built verification gates before startup. Vogtle 3&4 were the first reactors completed under Part 52. Operating licenses run 40 years — a number chosen originally for financial amortization, not engineering life — and can be renewed to 60 and now 80 via license renewal, the quiet regulatory machinery behind the fleet's longevity (visible in the detail panels' license-expiry field). Decommissioning, waste, fuel-cycle facilities, even the from the waste page: each runs under its own NRC licensing regime.
The system's defining tension is the one engraved in its statute: protect the public, and don't do more than that requires. Critics across decades have argued the NRC drifted toward the first at ruinous cost to the second — reviews measured in years and hundreds of millions of dollars, a standard of perfection no other energy source bears (recall from the safety page that per unit of energy, the technology being reviewed is already among the safest ever deployed). Defenders answer that the record — zero radiation deaths in US commercial power — is the review process working. Both can be partly right, and Congress has lately sided with reform: the bipartisan ADVANCE Act of 2024 ordered the NRC to streamline advanced-reactor licensing, cut fees for new designs, set deadlines, and — notably — revised the agency's mission to weigh the benefits of nuclear technology alongside its risks, the first such rebalancing in the agency's history. The early evidence of change: the first non-light-water construction permits in fifty years (Kairos's Hermes units), accelerated review schedules for Oklo's resubmitted application, and certification work proceeding on multiple SMR designs in parallel — each such milestone tending to appear, when it happens, in this map's news layer.
One more body belongs on this page because its sites keep appearing on this map: the Department of Energy and its national laboratories. DOE doesn't license commercial plants, but it funds demonstrations (Natrium and Xe-100 ride the Advanced Reactor Demonstration Program's cost-share), supplies test infrastructure, and — at Idaho National Laboratory, the descendant of the site where a reactor first lit lightbulbs in 1951 — hosts first units for Oklo, Aalo, and others under DOE authorization rather than NRC license. When a blue diamond sits in the Idaho desert, that's why.
